By engaging Smithblock for any services, you agree to the following terms. These terms apply to all work carried out by Smithblock unless a separate written agreement is in place.
1. Services
Smithblock provides website design, custom web application development, and business systems development services. All work is scoped and agreed upon before a project begins. Any changes to scope will be discussed and agreed in writing.
2. Intellectual Property
Upon full payment, you own the rights to the final deliverables produced for your project. We retain the right to showcase completed work in our portfolio and case studies unless otherwise agreed in writing. Any third-party assets, libraries, or open-source components used in your project remain subject to their respective licences.
3. Payment
Payment terms are agreed at the start of each project and outlined in the project proposal. Standard terms require a deposit before work begins, with the remaining balance due on completion or as outlined in the agreed payment schedule.
4. Client Responsibilities
You are responsible for providing accurate project requirements, content, assets, and timely feedback during the project. Delays in providing required materials may affect project timelines.
5. Limitation of Liability
Smithblock will deliver work to a professional standard and in line with the agreed scope. We are not liable for any indirect, incidental, or consequential damages arising from the use of our services or deliverables. Our total liability is limited to the amount paid for the specific project in question.
6. Termination
Either party may terminate a project by providing written notice. In the event of termination, payment is due for all work completed up to the date of termination.
7. Changes to These Terms
We may update these terms from time to time. Any changes will be reflected on this page. Continued use of our services constitutes acceptance of the updated terms.
